NORTH DEVON ATHLETIC CLUB: Constitution and Club Rules
Updated/Amended 31st March 2019
1. The name of the Club shall be called North Devon Athletic Club (hereafter in this document called the ‘Club’) and will be governed by the rules laid down by United Kingdom Athletics and will affiliate annually to England Athletics.
2. The Club is a Community Amateur Sports Club No. 03891
3. The purpose of the Club is to promote the amateur sport of athletics in its widest form within North Devon and community participation in the same.
4. The Club colours shall be Black and Sky blue.
a) Membership of the Club shall be open to anyone interested in the sport on application regardless of sex, age, disability, nationality, sexual orientation, religious or other beliefs. However, limitation of membership according to available facilities and manpower is allowable on a non-discriminatory basis.
b) The Club may have different classes of membership and subscription on a non-discriminatory and fair basis. The Club will keep subscriptions at levels which will not pose a significant obstacle to people participating.
c) The Club committee may refuse membership, or remove it, only for good cause such as conduct or character likely to bring the Club or sport into disrepute. Appeal against refusal or removal may be made to the members.
5. The Club will exist for the furtherance of amateur Track and Field athletics, Walking, Cross Country and Fell Running and Road Running for all ages.
6. The Club will consist of President, Vice Presidents, Chairman, Vice-Chairman, Honorary Secretary, Honorary Treasurer and paid up members.
7. The Annual General Meeting of the Club will held in March each year to receive the reports from the Honorary Secretary and Honorary Treasurer, to elect a committee for the following year and to deal with relevant matters specified together with nominations for offices and committee handed in writing to the Club Honorary Secretary before commencement of the Annual General Meeting.
8. The management of the Club shall be the sole responsibility of the committee consisting of the Chairman, Vice Chairman, Honorary Secretary, Honorary Treasurer and selected members.
9. Voting by members at the Annual General Meeting shall be restricted to paid up members of 15 years of age.
10. The committee shall have the power to:-
a) Appoint any sub-committee for the purposes of extra Club activities
b) Vote Club members onto the committee to fill any vacancy occurring thereon.
c) To appoint any representative necessary to the running of the Club.
11. Competitive members of the Club are defined as amateurs according to the current rules of United Kingdom Athletics and those of England Athletics acting as the agent of the governing body. An amateur is one who has never competed for a money prize or monetary consideration in any Athletic Sport or Game or been in any way interested in a staked wager made in connection with any athletic competition in which he was an entrant or competitor; who has never engaged in, assisted in, or taught any athletic exercise for pecuniary consideration, or in any way exploited his athletic ability for profit; and who has never taken part in any athletic competition with anyone whom is not a member.
12. An application for membership of North Devon Athletics Club shall be made in writing on the official form and shall include the names of one proposer, one seconder and in the case of anyone under the age of 18 the signature of a parent or guardian. It should be clearly stated on the application form if the applicant is currently or has been previously a member of another athletics club.
13. The annual subscription of the Club for the year 2019-2020 shall be:
Senior Athletes: £105 Junior Athletes (inc those in Full Time Education)n£85 Concessions for family of 3 or more athletes This includes athlete registration for competition under England Athletics Rules.
The subscription shall be paid on joining the Club and thereafter on the 1st day of April each year. A second claim athlete will pay 50% of the appropriate annual fee less the current England Athletics individual affiliation fee provided he or she have already affiliated.
The Club will collect from all active members the cost of the Annual Training Permits as laid down by the North Devon Athletic Trust and pay over such fees to the Trust.
For 2019-2020 the annual track permit is: Seniors Over 20 years: £50 Juniors: £30
14. a) The Committee shall have the power to expel any member whose subscription is six months in arrears, provided a month’s notice in writing shall have been sent to such a member by registered letter, addressed to his or her last known address, informing him or her of the proposed action of the committee.
b) The name and address of anyone so expelled from the Club shall be sent to England Athletics and shall be entered by such officer in a book (to be called ‘the Black Book’) kept for that purpose. Every person whose name has been so entered in the Black Book shall be suspended from competing in any meeting held under UKA rules until the liability causing his or her expulsion, which shall not exceed one year’s subscription, shall be discharged c) No member whose subscription is in arrears is eligible to take part in any competition promoted by the Club.
15. The Committee may expel from the Club any members they consider guilty of conduct detrimental to the interests
of the Club, or to Amateur Athletics generally; but any such member, on giving notice within seven days of the receipt by him or her of a notice of expulsion, may claim the right to appeal to a Special General Meeting which must be held within fourteen days of the withdrawal of his or her Club membership. Voting by proxy is not permitted and no member, whose subscription is six months in arrears, may vote.
16. A Special General Meeting must be called by the Honorary Secretary within fourteen days of receipt by him or her of a requisition in writing signed by eight members of the Club, stating the business to be brought before such a meeting. The Committee may also order the Honorary Secretary to call an Extraordinary General Meeting within fourteen days, stating the business to be brought before the members. No other business may be discussed at this meeting.
17. All Club training shall be controlled by a UKA qualified coach.
18. No Club member shall compete as a representative of the Club at any race, competition or meeting not under UKA rules.
19. All surplus income or profits are re-invested in the Club. No surpluses or assets will be distributed to club members or third parties.
20. Upon dissolution of the Club, any remaining assets shall given or transferred to another registered Community Amateur Sports Club, a registered Charity or the sport’s governing body.
21. No alterations or additions may be made to the Club’s constitutional rules except at the Annual General Meeting or a Specially Convened Meeting for that purpose.
